Prior Written Notices (PWNs)

Please note: All Prior Written Notices should be student specific and individualized, please be sure to include all areas of the IEP and have thorough explanations for parents/guardians. 

What about PWNs

Parents must receive written notice whenever the district proposes or refuses to begin or change the identification, evaluation, or educational placement of a student or the provision of a FAPE to a student (34 CFR §300.503(a))

Parents can sign that they agree (school moves forward), sign that they disagree, or not reply ("passive consent" after 14 calendar days*).

The district's proposals (e.g., a new IEP) are always dated 14 days after the PWN.

PWNs must be written in understandable language that is in the native language of parents

PWNs are a way for a district to document and acknowledge decisions made by the IEP team - they must be adhered to - and should be written following any conversation that a proposed change to an IEP has occurred whether a change is made or a proposal denied (changes proposed in 2-in-30 meetings, transition/change in placement meetings, graduation check-ins etc.)

Prior Written Notice Content Requirements

General guidance - avoid using acronyms, and use parent-friendly and professional language. Avoid words such as - thinks, feels, talked about, etc... Instead use - discussed, determined, agreed, etc...

  • What are you proposing?

    This box should provide a comprehensive summary of all items discussed at the IEP meeting, including both areas where changes are proposed and areas where the team determines that no changes are needed at this time. Parents should be able to read this section and have a clear understanding of what was discussed and decided during the IEP meeting without needing to read the entire IEP.

    Listed below are the specific areas that should be addressed in Box 1 of the PWN. Please note that not all areas will apply to every student. For example, some students may not have transition needs or an altered school day. Include only the areas that apply to the student and are relevant to the discussion and decisions made by the IEP team.

     

    • Goals and Objectives
    • Transition services, supports, and goals
    • Transfer of Rights
    • Special Education and related services (detail changes to services, minutes, frequency)
    • Child Specific Student Assistant support (if applicable)
    • Assistive Technology
    • Transportation 
    • Extended School Year (ESY)
    • Least Restrictive Environment (LRE)
    • Accommodations, Modifications, and Supports
    • State and District Assessments
    • Positive Behavior Support Plan (PBSP)
    • Graduation Plan (if applicable)
    • CTE: Career Technical Education (if applicable)
    • Transitioning to a less restrictive environment/home school(if applicable)
    • Nursing Services/Medications/Medical Plans (if applicable)
    • Altered school day (if applicable)
    • IEP-Driven Diploma Plan (if applicable)
  • This box is the reason WHY you are proposing changes to the new annual IEP.


    STUDENT  has been identified with [DISABILITY CATEGORY], with needs in the areas of [LIST AREAS FROM EVALUATION].  [SHE/HE] requires direct instruction in these areas to make sufficient academic progress.


    You are only noting the CHANGES that were made to the new annual IEP.

    Anything you changed in the IEP from the previous IEP needs to be addressed with detailed explanations of why they were changed.

    Examples of IEP changes could be:

    • Goals and Objectives
    • Transition services, supports, and goals
    • Transfer of Rights
    • Special Education and related services (detail changes to services, minutes, frequency)
    • Child-Specific Student Assistant support (if applicable)
    • Assistive Technology
    • Transportation 
    • Extended School Year (ESY)
    • Least Restrictive Environment (LRE)
    • Accommodations, Modifications, and Supports
    • State and District Assessments
    • Positive Behavior Support Plan (PBSP)

    The district determined that the services reflected in the proposed IEP (attached) are appropriate for the student, with new proposed change(s)  in [AREAS] added to reflect STUDENT'S [CHANGES – E.G. AGE, INCREASED INDEPENDENCE, ETC.]

  • Must include a description of each evaluation procedure, assessment, record, or report the agency used as the basis for the proposed action. The parent must be included.

    • This can include: parent, teacher, students, district, classroom performance, formal assessment results, progress on previous goals from the IEP

    • Needs to have DATE listed from IEP, Eval, or Progress notes

  • The notice MUST include a description of other options the IEP team considered and the reasons WHY those options were rejected

    • Teams should always be able to identify other options for an IEP

    • Other options considered could include: placement decisions, adding, discontinuing, increasing, decreasing services, one-to-one support, etc…

  • The notice will typically state: The district determined there are no other factors to be considered at this time unless there are significant factors that impact the proposed IEP, such as the family not agreeing with the IEP decisions or a parent not being present at an IEP Team meeting.

Reviewing your Pwn

When reviewing your PWN have you checked for the following:

  1. The notice includes a description of the action proposed or refused by the agency.

  2. The notice includes an explanation of why the agency proposes or refuses to take the action.

  3. The notice includes a description of each evaluation procedure, assessment, record, or report the agency used as a basis for the proposed or refused action.

  4. The notice includes a description of other options that the IEP Team considered.

  5. The notice includes reasons why other options considered were rejected by the team.

  6. The notice includes a description of other factors that are relevant to the agency's proposal or refusal. If no other relevant factors are identified, “none at this time” is an acceptable response.
